Who we are and these terms
The What to Wear app (listed in the stores as "W2W: What 2 Wear") and the website whattowearapp.com are run by
Fashion decider ("we", "us", "our"), Belmont Works, 4 Belmont Row, Birmingham B7 7RQ, United Kingdom.
These terms are an agreement between you and us. By downloading or using the app, you agree to them. If you do not agree, please
do not use the app.
Our Privacy Policy explains how we handle your data. It is part of how the app works, so please read it
too.
What the app does
The app helps you decide what to wear. You add photos of your own clothes. The app builds a digital wardrobe on your phone, keeps a backup copy on our servers, and suggests an
outfit from it, based on the weather, your style and what you wore recently. You can also save outfits, plan days ahead, keep a
wear log and pack for trips.
- Suggestions are ideas, not advice. They are made automatically, partly with an AI service. They can be wrong or not to your taste. You decide what to wear.
- The weather can be wrong. Forecasts come from third-party providers and are based on your rough location. Check the sky before you leave without a coat.
- Item details can be wrong. The app guesses each item's type and colour from the photo. You can correct them.
Your account and age
- You must be at least 13 years old to use the app. If the law where you live sets a higher age for agreeing to these terms or to data use, you need a parent's or guardian's consent until you reach it.
- You can sign up with email, Apple or Google. Please give accurate details.
- Keep your sign-in details safe. You are responsible for what happens in your account. Tell us straight away if you think someone else has used it.
- One account is for one person. Please do not share it or sell it.
Your photos and content
You own your photos and everything else you add, such as outfits, plans and notes ("your content"). We do not
claim ownership of it.
To run the app, you give us a limited permission (a licence) to use your content. We may only use it to provide the service to
you. That means we can process it, make cut-outs, read item details, store it, back it up and show it to you. The licence is
non-exclusive and free. It lets our service providers do the same on our behalf. It ends when you delete your content or your
account, except for copies in backups until they expire, and anything we must keep by law.
When you upload content, you promise that:
- you have the right to upload it, for example because you took the photo or have permission;
- you will not upload photos of other people without their permission;
- it is not illegal, harmful, sexually explicit or hateful, and does not break anyone else's rights.
We may remove content that breaks these terms.
Using the app fairly
Please do not:
- use the app for anything illegal, or to harm or harass anyone;
- try to get into accounts, systems or data that are not yours;
- copy, change, reverse engineer or resell the app, except where the law allows it;
- use bots, scripts or scraping, or try to get around free-plan limits;
- overload, disrupt or attack our servers, or upload viruses or harmful code;
- use the app or its output to build a competing service.
Premium and the free plan
The free plan
You can use the app for free, with weekly limits, such as a set number of suggestions. We may change what is free and what the
limits are. If we reduce the free plan in a way that matters, we will tell you in the app.
Premium
- Bought through the store. Premium is sold through the Apple App Store or Google Play. Apple or Google take the payment and bill you. We never see your card details.
- Price. The price is shown in the store before you buy, in your local currency, including any taxes the store charges.
- It renews automatically. Your subscription renews at the end of each period, and you are charged again, until you cancel. To stop the next charge, cancel at least 24 hours before the current period ends.
- Free trials. If we offer a free trial, you are charged when it ends unless you cancel at least 24 hours before.
- Cancel or manage it in your store settings: App Store subscriptions or Google Play subscriptions. Deleting the app or your account does not cancel it.
- After you cancel, Premium keeps working until the end of the period you paid for.
- Refunds are handled by Apple or Google under their own rules. We cannot issue refunds ourselves. Ask Apple at reportaproblem.apple.com, or Google through Google Play.
If we change the price of Premium, Apple or Google will tell you before it applies, as their rules require.
If you got the app from Apple
If you downloaded the app from the Apple App Store, Apple's
standard licence agreement (EULA) also applies, alongside these terms. In addition:
- This agreement is between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Your licence. You may use the app on Apple devices you own or control, as allowed by the App Store's Usage Rules.
- Support. We, not Apple, provide support and maintenance for the app. Apple has no duty to do so.
- Warranty. If the app does not meet any warranty that applies, you can tell Apple, and Apple will refund the price you paid for the app, if any. As far as the law allows, Apple has no other warranty duty for the app. Any other claims, losses or costs from a failure to meet a warranty are our responsibility, as these terms describe.
- Claims. We, not Apple, are responsible for dealing with any claims about the app or your use of it. This includes product liability claims, claims that the app breaks a law or regulation, and claims under consumer protection, privacy or similar laws.
- Intellectual property. If someone claims the app or your use of it infringes their intellectual property, we, not Apple, will deal with the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You confirm that you are not in a country under a US government embargo, or one the US government has labelled as "terrorist supporting", and that you are not on any US government list of prohibited or restricted parties.
- Other terms. You must follow any third-party terms that apply when you use the app, such as your mobile network's terms.
- Apple can enforce these terms. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you.
If you have questions or complaints about the app, contact us, not Apple. Our details are in "Contact us".
If you got the app from Google Play
If you downloaded the app from Google Play, the Google Play Terms of Service also apply to your download and any purchases. Google
is not responsible for the app. If these terms and Google's terms conflict about your purchase, Google's terms apply to that
purchase.
Other services in the app
Some features use services run by other companies:
- Google Images. You can search for a picture of an item in a browser inside the app. That search goes to Google and follows Google's terms and privacy policy.
- Weather. Forecasts come from weather providers. We do not control them and cannot promise they are right.
- Apple, Google and RevenueCat handle sign-in, payments and subscriptions.
We are not responsible for these services or their content. Their own terms apply when you use them.
Changes and availability
We work to keep the app running, but we cannot promise it will always be available or free of errors. It may be paused for
updates, repairs or reasons outside our control.
We may change, add or remove features. We may also stop offering the app. If we stop the app, we will give you reasonable notice
where we can, and the chance to get a copy of your data. If you have paid for a period you can no longer use, contact us and we
will help you get a fair refund.
Please keep the app up to date. Older versions may stop working.
Our app and brand
The app, the website, their design, text, code and our name and logos belong to us or the people who license them to us. These
terms give you a personal, non-transferable right to use the app. They do not give you any other rights to our property.
Feedback
We love hearing ideas. Send them from the app (Settings → Feedback) or by email. If you
send feedback, we may use it to improve the app without paying you or owing you anything.
Ending your use
You can stop at any time. Stop using the app and ask us to delete your account: in the app go to Settings → Delete account, which opens our
deletion form, or email us. See our Privacy Policy for what we delete. Remember to cancel any subscription in your
store settings.
We may suspend or close your account if you seriously or repeatedly break these terms, misuse the app, or if the
law requires it. Where it is reasonable, we will warn you first and explain why. If we close your account without good reason, we
will refund any Premium time you have paid for and not used.
The parts of these terms that are meant to last, such as "Our responsibility to you" and "Which law applies", still apply after your use ends.
Our responsibility to you
Your statutory rights are not affected. If you are a consumer, the law gives you rights that these terms cannot
take away. For example, digital content you pay for must be as described, fit for purpose and of satisfactory quality.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent
misrepresentation, or for anything else that cannot be limited by law.
Apart from that:
- We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable.
- The app is for personal use. We are not responsible for business losses, such as lost profit or lost business opportunity.
- We are not responsible for choices you make based on a suggestion or a weather forecast, such as what you wear on a given day.
- We are not responsible for problems caused by things outside our reasonable control, or by services run by other companies.
- If something we supply damages your device or other digital content you own, because we did not use reasonable care and skill, we will either repair the damage or pay you fair compensation.
The backup copy is there to restore your wardrobe on a new phone. It is not a photo storage service. Please keep your own copies of any photos that matter to you.
Which law applies
These terms are governed by the laws of England and Wales. Any dispute will be handled by the courts of England and Wales.
But if you live elsewhere in the UK or in the EU, you can also bring a claim in the courts where you live. You also keep the
protection of the consumer laws of the country where you live.
If you have a problem, please contact us first. Most things can be sorted out quickly by email.
Changes to these terms
We may update these terms, for example when the app or the law changes. The date at the top shows when they last changed. If we
make an important change, we will tell you in the app or by email before it applies. If you keep using the app after that, the
new terms apply. If you do not agree with them, you can stop using the app and delete your account.
